By using TiketBurst you accept these terms. We encourage you to read them carefully: they set out your rights and obligations, whether you are a buyer, an organizer or a fundraiser owner.
This English text is an unofficial translation provided for convenience only. The French version is the sole legally binding text; in the event of any discrepancy or dispute as to interpretation, the French version prevails.
These General Terms of Use and Sale (the "Terms") govern access to and use of the TiketBurst platform (the "Service"), available in particular at https://tiketburst.com.
The Service allows (i) the purchase of event tickets, (ii) the creation and management of events by organizers, (iii) fundraising through collection campaigns, and (iv) the broadcasting and viewing of live events.
By creating an account, buying a ticket, publishing an event, contributing to a fundraiser or otherwise accessing the Service, you acknowledge that you have read, understood and accepted these Terms without reservation, together with the Privacy Policy.
If you use the Service on behalf of a legal entity, you represent that you have authority to bind it contractually.
Minimum age. The Service is reserved for persons aged at least 16. Certain events may impose a higher age limit, stated on the event page and checked at the door by the organizer.
Creating an account requires a valid mobile telephone number and/or an email address, verified by one-time code (OTP). The telephone number is the account's primary identifier.
You undertake to:
Any transaction carried out using your credentials is deemed to have been carried out by you. TiketBurst cannot be held liable for the consequences of disclosing your credentials or OTP codes to a third party, whether deliberately or not.
TiketBurst sells the ticket in its own name. We act as merchant of record, and not as an agent, broker or mere technical intermediary of the Organizer.
It follows that:
This capacity does not make TiketBurst responsible for the physical organisation, the safety or the running of the event, which are the exclusive responsibility of the Organizer.
Prices are displayed in CFA francs (XOF), inclusive of tax where applicable. The total amount payable, including any service fee, is displayed before the order is finally confirmed.
Buyer-side fees. TiketBurst does not charge buyer fees by default. Where a service fee is applied, it is displayed separately before payment.
Formation of the contract. The order becomes firm and final once payment is confirmed by the PSP. The ticket is then issued and made available in your account, and notified by email and/or SMS.
Temporary hold. Selecting tickets places a time-limited hold on inventory. If that period expires without a completed payment, the tickets are automatically returned to sale.
Manifest pricing error. In the event of a manifest error in a displayed price, TiketBurst may cancel the order and refund it in full, with no further compensation.
Payments are accepted by electronic money and by bank card, through our providers: Wave, Orange Money, MTN Mobile Money, Moov Money, and through payment aggregators (CinetPay, GeniusPay) for Visa and Mastercard.
Payment data is collected and processed directly by the relevant PSP. TiketBurst stores neither your full card number nor your electronic money PIN.
PSPs apply their own terms and conditions and may charge fees of their own. Processing times depend on the operator; a payment by electronic money may require confirmation on your phone.
Failed or duplicate payment. If you are debited without a ticket being issued, or debited twice, contact support@tiketburst.com. After verification with the PSP, amounts wrongly taken are returned to you.
The ticket is issued in dematerialised form and carries a dynamic QR code regenerated periodically by means of a cryptographic signature. A screenshot or photograph of the QR code may be refused at the door.
Device binding. Where the Organizer enables this option, the ticket is bound to the device on which it was first opened. This setting is stated on the event page.
A ticket may only be scanned once. Any attempt to duplicate, reproduce or circumvent the control mechanism voids the ticket, without refund and without prejudice to legal proceedings.
You are responsible for keeping your ticket confidential. TiketBurst cannot be held liable for use of a ticket by a third party to whom you passed it outside the official transfer mechanism.
Official transfer. The Service provides a personal transfer function. The transfer voids the original QR code and generates a new one in the recipient's name. This function may be disabled by the Organizer.
Resale. Where the Organizer permits it, a ticket may be relisted on the Service's marketplace. The Organizer may set a resale price cap; any listing above that cap is refused.
Any resale outside the Service, in particular above the permitted cap or by passing on the QR code, is prohibited and voids the ticket without refund.
Where the Organizer permits it, certain tickets may be paid for in several instalments. The number of instalments and the applicable minimum amount are stated on the event page before payment.
A reservation, not credit. Instalment payment is a reservation with split payment: your place is held from the first instalment, but the ticket is only issued once payment is complete. No credit is granted to you and no interest is charged.
Schedule. All instalments fall due before the date of the event. The schedule is set when you order and communicated to you; each due date triggers a reminder. As instalments cannot be debited automatically from an electronic money account, it is for you to confirm each payment.
Default. Failing payment in full within two (2) days after the final due date, the order is cancelled automatically, the place is returned to sale and the ticket is not issued.
Refund on default. Amounts already paid are refunded to you, less an administration fee of 1% of those amounts. That fee covers the non-recoverable payment costs incurred on each instalment, and the holding of a place withdrawn from sale for the duration of the plan. The amount is stated to you before your order is confirmed.
You may settle the outstanding balance early at any time; the ticket is then issued immediately.
Cancellation by the Organizer. If an event is cancelled, you are entitled to a full refund of the ticket price. The refund is initiated by TiketBurst to the original payment method.
Postponement. If an event is postponed, your ticket remains valid for the new date. If that date does not suit you, you may request a refund within the period stated in the postponement notice.
Substantial change. A change of venue, a major change to the announced line-up or a significant change of time gives rise to a right to a refund.
Event policy. TiketBurst sets a minimum refund standard applicable to every ticket sold on the Service. An Organizer may offer more favourable terms, never less. The terms applicable to your ticket are displayed on the event page before payment.
How refunds are made. Refunds are made to the original payment method. Where that method cannot technically accept a refund, we contact you to agree another means of repayment. No credit note replaces a cash refund without your express agreement.
Service fees, where they have been charged, are refunded if the cancellation is attributable to the Organizer or to TiketBurst.
Any credit held on your account may be used to buy tickets and other services on the Service.
That credit is not convertible into cash, is not transferable, bears no interest and constitutes neither a deposit, nor electronic money, nor a payment account within the meaning of BCEAO Instruction No. 008-05-2015. It does not constitute a debt payable in cash.
Accepting credit is always optional for the user: where a refund is owed to you, a cash refund remains available.
TiketBurst sells your event's tickets as merchant of record; you supply the event. In that respect you are our supplier.
You undertake to:
Where TiketBurst refunds a ticket holder, the corresponding amount is deducted from sums owed to the Organizer or, failing a sufficient balance, is the subject of a demand for repayment.
You indemnify TiketBurst against any third-party claim arising from the event, its cancellation, its conduct or its content.
Commission. A commission is deducted from the gross amount of each confirmed order. The applicable rate is the one displayed in your organizer area and on the Pricing page at the time of going on sale. A reduced rate may apply to an organizer's first event.
Escrow. Funds from sales are held by TiketBurst until a period following the end of the event has elapsed, in order to cover refund requests, disputes and unpaid amounts. This mechanism protects buyers and organizers alike.
Payout. At the end of escrow, the net balance (sales proceeds, less commission, PSP fees, refunds and any disputes) is made available in your wallet and may be withdrawn to your electronic money or bank account.
Withdrawal conditions. Withdrawal is subject to the applicable identity verification (section 13) and to the accuracy of the settlement details provided. TiketBurst may suspend a payout in the event of suspected fraud, an ongoing dispute, a legal obligation or a request from a competent authority.
Set-off. TiketBurst may set off any sum owed to it (advanced refunds, unpaid amounts, chargeback penalties) against sums owed to the Organizer.
In accordance with applicable regulation on combating money laundering and terrorist financing (AML/CFT), and with the requirements of our financial partners, TiketBurst operates identity verification measures.
Enhanced verification is required in particular for:
Verification may involve submitting an official identity document and a selfie, processed by our specialist provider Smile ID. The terms of that processing are described in the Privacy Policy.
TiketBurst may refuse, suspend or terminate a relationship, freeze funds and make the reports required to the competent authorities, in particular CENTIF, without those measures giving rise to any right to compensation. We are not obliged to inform you of a suspicious activity report where the law forbids it.
Fundraisers allow donations to be collected for a project, a cause or a person. The fundraiser owner is solely responsible for the accuracy of the presentation, the use of the funds and the delivery of any rewards.
A donation is not a purchase: it gives rise to no reward guaranteed by TiketBurst and is, in principle, non-refundable, save in cases of proven fraud, removal of the fundraiser or legal obligation.
TiketBurst may suspend a fundraiser, freeze the funds or return them to donors in the event of suspected fraud, breach of these Terms or a decision of a competent authority.
Fundraisers are subject to enhanced identity verification of the fundraiser owner.
Certain events are accessible by live stream, free of charge or for payment. Access is strictly personal and limited to the stated number of simultaneous sessions.
Any recording, retransmission, sharing of an access link or public provision of the stream is prohibited and results in immediate closure of access, without refund.
Stream quality depends on your connection and on factors beyond our control. TiketBurst does not guarantee an uninterrupted stream. In the event of a substantial streaming failure attributable to the Service, a refund of paid access may be granted.
The Organizer warrants that it holds all rights necessary for the broadcast, including copyright, neighbouring rights and image rights of the persons filmed.
TiketBurst issues an invoice for the sale of the ticket to the Buyer, and a commission statement to the Organizer.
Invoices are issued in accordance with Ivorian regulation on standardised electronic invoicing (FNE) of the Directorate General of Taxes, where it applies.
Each party remains responsible for its own reporting and tax obligations. The Organizer is responsible in particular for declaring and paying the taxes due in respect of its activity and its event.
It is prohibited to use the Service to:
Events and fundraisers are moderated before publication. TiketBurst may refuse, unpublish or remove any infringing content, and suspend the account concerned.
The platform, its software components, its visual identity, its trade marks and its databases are the exclusive property of TiketBurst or its licensors. Nothing in these Terms transfers any rights.
You retain ownership of the content you publish. You grant TiketBurst a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and display that content solely for the purposes of operating and promoting the Service and your event, for the duration of its publication and of any necessary archives.
You warrant that you hold all rights necessary in the content published.
The processing of your personal data is described in our Privacy Policy, which forms an integral part of these Terms.
The processing carried out is governed by Ivorian Law No. 2013-450 of 19 June 2013 on the protection of personal data, supervised by the Telecommunications/ICT Regulatory Authority of Côte d'Ivoire (ARTCI).
Sharing with the Organizer. When you buy a ticket, the data strictly necessary for access control and for running the event (name, ticket type, scan status) is disclosed to the Organizer, who becomes controller of it for their own purposes.
The Service is provided with the aim of continuous availability, without any guarantee that it will be entirely free of interruption. Maintenance operations may take place.
TiketBurst answers for its own obligations: selling the ticket, collecting payment, refunding in the cases provided for, making the admission title available and paying funds over to the Organizer.
TiketBurst is not responsible for the running of the event, its content, on-site safety, or damage occurring at the event, which are matters for the Organizer and, where applicable, the venue operator.
To the extent permitted by law, TiketBurst's liability in respect of an order is capped at the total amount actually paid by the Buyer for that order. No limitation applies in cases of wilful misconduct, gross negligence or personal injury.
Neither party may be held liable for a failure resulting from an event of force majeure within the meaning of Ivorian law: natural disaster, epidemic, serious public disorder, decision of an authority, general interruption of telecommunications or electricity networks, or general failure of payment systems.
If an event is cancelled for reasons of force majeure, the Buyer's refund rights under section 9 continue to apply.
You may close your account at any time from your settings. Closure does not release you from obligations arising before it, in particular holding an event whose tickets have already been sold.
TiketBurst may suspend or terminate access to the Service, with prior notice where the law requires it, in the event of a serious breach of these Terms, fraud, non-payment, or a legal obligation.
Certain data is retained after an account is closed for the period imposed by legal, accounting and AML/CFT obligations, on the terms described in the Privacy Policy.
Any complaint must first be addressed to support@tiketburst.com. We acknowledge receipt and endeavour to provide a reasoned response as promptly as possible.
The Service provides an internal dispute mechanism allowing both Buyer and Organizer to open a case, submit evidence and obtain a reasoned decision.
Failing an amicable solution, the dispute may be brought before the competent courts in accordance with section 24.
These Terms are governed by Ivorian law.
Failing amicable resolution, any dispute falls within the jurisdiction of the courts of Abidjan, subject to the mandatory rules of jurisdiction protecting consumers, which allow a consumer to bring proceedings before the court of their own domicile.
TiketBurst may amend these Terms to reflect legal or technical developments, or changes to its offering.
Any substantial change is brought to your attention by appropriate means (email, notification within the Service) before it takes effect. The Terms applicable to an order are those in force on the date of that order.
Continuing to use the Service after a change takes effect constitutes acceptance of the amended Terms.
Language. These Terms are drawn up in French. In the event of translation, only the French version is authoritative.
Partial invalidity. If any provision is held invalid, the remaining provisions continue to apply.
No waiver. Failure to rely on a breach does not constitute a waiver of the right to rely on it later.
Assignment. TiketBurst may assign these Terms as part of a reorganisation or a transfer of business. You may not assign your rights without our written agreement.
Entire agreement. These Terms, the Privacy Policy and any special conditions constitute the entire agreement between the parties.
